Terms of Service

Please read these terms. They include an assumption of risk, a disclaimer of warranties, a limit on our liability, and an agreement to resolve disputes by individual arbitration rather than in court or by class action. By installing or playing Golf Kingdom you accept them.

1. Who we are and what this is

Golf Kingdom (the "Game") is published by the operator named in the app's settings (the "Publisher", "we", "us"). These terms are a binding agreement between you and the Publisher. If you do not agree, do not play.

2. Who can play

You must be at least 13 years old. If you are under 18, a parent or legal guardian must review and accept these terms on your behalf and is responsible for your use, including any purchases. We may refuse, suspend or terminate access at any time.

3. Your account and licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to play the Game for entertainment. You may not copy, modify, reverse engineer, resell, or exploit any part of the Game, interfere with its servers, or use bots, scripts, modified clients, or multiple accounts to gain rewards or prizes.

4. Virtual items and currency

Coins, crowns, jewels, passes, items and every other in-game thing ("Virtual Items") are licensed, not sold. They have no real-world value, cannot be exchanged for money or anything of value outside the Game, are not transferable, and may be changed, rebalanced, limited or removed at any time as the Game evolves. Purchases are made through the Apple App Store under Apple's terms and refund rules; Virtual Items are delivered immediately and are non-refundable except where the law requires otherwise. Prices may change.

5. Events and prizes

Daily, weekly and monthly events and design challenges are governed by the Official Rules, which are part of these terms. No purchase is necessary. Prizes are Virtual Items only. Results may be verified and, in cases of suspected cheating, voided. Apple Inc. is not a sponsor of, and is not involved in, any event.

6. Your content

You keep ownership of courses, names and other content you create. You grant us a worldwide, royalty-free, perpetual licence to host, display, adapt and share that content inside the Game and in promotion of the Game, and you confirm you have the right to grant it. Do not upload anything unlawful, hateful, harassing, sexual, infringing, or that impersonates someone else. We may remove content and suspend accounts at our discretion.

7. Play responsibly — health and safety

You play at your own risk. The Game is a video game played on a handheld device. Do not play while driving, cycling, walking in traffic, operating machinery, or in any situation where your attention is needed for safety. Take regular breaks. A small percentage of people may experience seizures or blackouts when exposed to flashing lights or patterns; if you or anyone in your family has an epileptic condition, consult a doctor before playing, and stop immediately if you experience dizziness, altered vision, eye or muscle twitching, disorientation, involuntary movement, or convulsions. Golf Kingdom does not provide medical, financial, or professional advice of any kind.

8. Assumption of risk

To the fullest extent permitted by law, you assume all risk arising from your use of the Game, including loss of progress, Virtual Items, or data; interaction with other players' content; and any physical, emotional, or financial consequence of play. You are responsible for the device, network and data charges you use to play.

9. Disclaimer of warranties

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. Some jurisdictions do not allow these exclusions; in that case they apply to the extent permitted.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE PUBLISHER AND ITS OWNERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL OR VIRTUAL ITEMS, ARISING FROM OR RELATED TO THE GAME, HOWEVER CAUSED. OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US THROUGH THE GAME IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE AND (B) FIFTY US DOLLARS. Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by our negligence where such limits are unlawful.

11. Indemnity

You agree to defend, indemnify and hold harmless the Publisher from claims, damages, and expenses, including reasonable legal fees, arising from your content, your breach of these terms, or your violation of any law or third-party right.

12. Disputes: arbitration and class-action waiver

Please contact support@golf-kingdom.com first; most issues can be fixed informally within 30 days. If not, you and the Publisher agree to resolve any dispute by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. You waive any right to bring or join a class, collective, or representative action. Arbitration takes place in the state of the Publisher's principal place of business or remotely, in English. You may opt out of this section by emailing us within 30 days of first accepting these terms. If this section is found unenforceable, disputes go to the state or federal courts located in that state, and you consent to their jurisdiction.

13. Governing law

These terms are governed by the laws of the state of the Publisher's principal place of business and the federal laws of the United States, without regard to conflict-of-law rules. If you live in the European Union or the United Kingdom, you keep the protections of your local consumer law.

14. Apple App Store terms

These terms are between you and the Publisher only, not Apple. Apple has no obligation to furnish maintenance or support for the Game. To the extent any warranty applies and is not disclaimed, you may notify Apple and Apple will refund the purchase price of the Game; Apple has no other warranty obligation. The Publisher, not Apple, is responsible for addressing product claims, including product liability, legal or regulatory compliance, and consumer protection claims, and for investigating and resolving any third-party intellectual property claim. You must comply with applicable third-party terms when using the Game. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You represent that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.

15. Copyright complaints

If you believe content in the Game infringes your copyright, email support@golf-kingdom.com with the work, the location of the material in the Game, your contact details, a statement of good-faith belief, and a statement under penalty of perjury that you are authorised to act. We will remove infringing content and may terminate repeat infringers.

16. Changes, termination, and the rest

We may update these terms; the version number and date above will change, and the Game will ask you to accept material changes. We may suspend or discontinue the Game or any feature at any time, and will give reasonable notice before shutting the service down. If any provision is unenforceable, the rest remains in force. These terms, the Privacy Policy, and the Official Rules are the entire agreement between us about the Game. Questions: support@golf-kingdom.com.
